2. 破坏海洋生态刑法规定

禁渔期非法捕捞处罚标准:如果犯罪嫌疑人违反保护水产资源法规,在禁渔区、禁渔期或者使用禁用的工具、方法捕捞水产品,情节严重的,就构成了非法捕捞水产品罪。

根据我国《刑法》的相关规定可以知道,如果构成非法捕捞水产品罪,情节严重的,依法判处三年以下有期徒刑、拘役、管制或者罚金。其中,如果符合下面几个情形之一的,就属于“情节严重”:

1、非法捕捞水产品超过一万公斤以上或者价值十万元以上;

2、非法捕捞有重要经济价值的水生动物苗种、怀卵亲体达到二千公斤以上或者价值二万元以上的;

3、在水产种质资源保护区内捕捞水产品达到二千公斤以上或者价值二万元以上的;

4、在禁渔区域内,使用禁用的工具或者方法捕捞;

5、在禁渔期间,使用禁止使用的工具或者方法捕捞;

6、在公海使用禁用渔具从事捕捞作业,造成严重影响;

7、其他情节严重的情形。

本罪侵犯的客体是国家保护水产资源的管理制度。水产资源,包括具有经济价值的水生动物和水生植物,是国家的一项宝贵财富。为了加强对水产资源的保护,国家通过立法对水产资源繁殖、养殖和捕捞等方面作了具体的规定。国家鼓励、扶持外海和远洋捕捞业的发展,合理安排内水和近海捕捞。在内水、近海从事捕捞业的单位和个人,必须按照捕捞许可证关于作业类型、场所、时限和渔具数量的规定进行作业。不得在禁渔区和禁渔期进行捕捞,不得使用禁用的渔具、捕捞方法和小于规定的最小网目尺寸的网具进行捕捞。急功近利,竭泽而渔,非法捕捞水产品,破坏国家对水产资源的管理制度,危害水产资源的存留和发展。因此,必须依法对非法捕捞水产品的犯罪予以惩罚。

《刑法》第三百四十条 非法捕捞水产品罪,违反保护水产资源法规,在禁渔区、禁渔期或者使用禁用的工具、方法捕捞水产品,情节严重的,处三年以下有期徒刑、拘役、管制或者罚金。

3. 破坏海洋生态环境的例子

1、垃圾污染

工业冷却水和工程残土、垃圾及疏浚泥等。前者入海后能提高局部海区的水温,使溶解氧的含量降低 ,影响生物的新陈代谢,甚至使生物群落发生改变;后者可破坏海滨环境和海洋生物的栖息环境。

2、噪声污染

利用天然声纳进行导航和捕猎,让无脊椎动物深受其害。勘探船产生的声音污染对头足类动物以及其他海洋动物的生存造成不利影响。

3、过度捕捞

人类的捕鱼活动导致海洋中生存的某种鱼类种群不足以繁殖并补充种群数量。现代渔业捕获的海洋生物已经超过生态系统能够平衡弥补的数量,结果使整个海洋系统生态退化。

4、冰川融化

由于冰盖的融化,奇特的低盐度海水正在慢慢的消失,截止到2002年, 96%的低盐度栖居环境已经消失殆尽。大部分以冰川径流作为供水源的地区将会发生严重的缺水危机。

5、石油泄漏污染

石油污染在海洋表面形成面积广大的油膜,阻止空气中的氧气向海水中溶解,同时石油的分解也消耗水中的溶解氧,造成海水缺氧,对海洋生物产生危害,并祸及海鸟和人类。

对海洋生态系统的破坏主要表现在:(

1)渔业捕捞过度和海水养殖管理不善。海洋捕捞产量的迅速增加是机动渔船大量增加的结果。但是,逐年增长的捕捞力量主要集中在近海渔场,造成近海渔业资源开发利用过度。过度的开发利用导致优质鱼类资源严重衰退,渔获物中主要经济鱼类所占比例逐年减少,个体也趋向小型化、低龄化,低质小杂鱼所占比例逐年增加。
